1. Acceptance of Terms
By accessing or using the Momentum application ("Momentum," the "Service," or "we"), available at firemomentum.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
You must be at least 18 years old to use Momentum. By using the Service, you represent and warrant that you are 18 years of age or older.
2. Description of Service
Momentum is an AI-powered daily routine and wellness coaching app. The Service provides personalized plans, coaching, and habit tracking across four pillars: Nutrition, Movement, Sleep, and Energy, along with goal-based planning.
Momentum is currently offered as a beta version. Features may be added, changed, or removed at any time, and the Service may contain bugs, errors, or interruptions.
3. AI Coaching Disclaimer
Momentum uses artificial intelligence (Anthropic's Claude) to generate coaching advice, plans, and recommendations. This coaching is provided for general wellness guidance only and is NOT a substitute for professional medical, nutritional, or mental health advice, diagnosis, or treatment.
Always consult a qualified healthcare professional before making significant changes to your diet, exercise, sleep, or overall health routine. Never disregard professional medical advice or delay seeking it because of something you read or received within the Service. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
4. User Responsibilities
By using the Service, you agree that:
- You are responsible for the accuracy and completeness of the information you provide.
- You will not use the Service for any unlawful, fraudulent, or harmful purpose.
- You will not attempt to reverse engineer, decompile, scrape, disrupt, or otherwise misuse the Service or interfere with its normal operation.
5. Health Data
By using the Service, you consent to the collection and processing of health-related data (such as profile details, dietary preferences, sleep, movement, energy, and check-in responses) as described in our Privacy Policy.
You acknowledge that AI-generated health coaching has inherent limitations: it may be incomplete, inaccurate, or unsuitable for your individual circumstances, and it cannot account for everything a qualified professional would consider.
6. Intellectual Property
Momentum and all associated content, software, design, and trademarks are owned by Momentum and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our permission.
You retain ownership of the personal data you provide. We do not claim ownership of your personal data, and we use it only to provide the Service as described in the Privacy Policy.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis during beta, without warranties of any kind, whether express or implied. We make no guarantees regarding uptime, availability, the accuracy or reliability of AI coaching, or any specific health, fitness, or wellness outcomes.
8. Limitation of Liability
To the fullest extent permitted by law, Momentum shall not be liable for any health decisions you make based on coaching, plans, or recommendations provided by the Service, nor for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total maximum liability to you for any claim arising out of or relating to the Service is limited to the total amount of fees you have paid to use the Service, which is currently $0 during the beta period.
9. Changes to Terms
We may update these Terms of Service from time to time. If we make material changes, we will notify users through the app or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
10. Governing Law
These terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles.
